TERMS & CONDITIONS
Champ Mouthguards Pty Ltd (ABN 51 635 267 248) owns, operates and provides this website and its related products & services subject to the following terms and conditions of use of this website.
Terms and Conditions may be revised without notice. We recommend that you should therefore visit the Terms & Conditions page periodically to review the Terms and Conditions. Your order will be subject to the Terms as advertised on the website at the time when you order products from the website.
In these Terms of Conditions:
- All references to “CHAMP”, “us”, “we”, and “our” refers to Champ Mouthguards Pty Ltd.
- “Website” means CHAMP’s website https://champmouthguards.com.
- “You”, “you” and “your” refers to anyone who visits and/or uses this website and/ or the products, and accepts these Terms and Conditions.
- “Products” means the products available for sale by CHAMP through the Website.
- “Terms and Conditions” means the terms and conditions set out in this document.
Our website allows you to create a user account. The website requires you to set up an account using a username and/or password(s) which you are solely responsible for maintaining the confidentiality of your account and password(s). You agree to accept full responsibility for all activities that occur under your account or password(s). CHAMP reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion. Any information you provide to us will be current, accurate and complete. You could be held liable for losses incurred by CHAMP due to the unauthorised use of your account and/or password either with or without your knowledge. It is your responsibility to notify CHAMP immediately if you detect any unauthorised use of your account and/or password(s), or other breach of security.
LINKS TO OTHER SITES
The website contains hyperlinks to websites owned and operated by third parties. We do not accept any responsibility for the content of third party websites or web pages, nor do we accept responsibility for any losses or penalties incurred as a result of your use of any links or reliance on the content of any website to which the website is linked.
Our promise to You that any product purchased from the website is of satisfactory quality and reasonably fit for the purpose for which the product was supplied.
Delivery of your goods will be through a 3rd Party Service provider. In the event your delivery of a product is lost or fails to be delivered, CHAMP will ensure all reasonable attempts are made to recover the Products on your behalf and (at its discretion) agree to provide you with a replacement Product.
CHAMP will not be liable or otherwise responsible for any failure of delivery, shortage, defect or damage, losses, damages, liabilities, costs or expenses sustained by you or any other party in respect of any delivery issues, losses or defects within 48 hours of delivery of the Products to your nominated location.
In the event you order a custom made mouthguard, We will send you an Impression Kit containing two putty packs and one impression tray, which give you two attempts at doing your impression correctly. Read all instructions carefully and watch Our instructional video by clicking here.
If your two impressions are done incorrectly you will have to order another Impression kit for $25 excluding postage and handling. If you choose to not order another Impression Kit, but instead choose to have your money refunded, $25 will be withheld from your refund amount to cover the cost for the initial impression kit sent.
There will be no contract of any kind between you and us unless and until we have accepted your order and payment received. You will receive an order confirmation via email confirming that your order has been accepted. The order confirmation will also contain details of when your order will be fulfilled and your product delivered. At any point up until then, we may decline to supply products to you without giving any reason.
You will be charged for the goods upon acceptance of your order and a contract will be made between you and us.
We store all contracts made and we recommend that you file these too, as subsequently the documents will not be accessible.
HEALTH INSURANCE REBATES
The Products purchased online are not eligible for health fund rebates. In order to achieve a rebate through your private health insurance provider, you will need to visit our surgery by contacting 02 9311 7447 to book your appointment during regular business hours or alternatively any of our prefered CHAMP providers in respect to their normal business hours.
A minimum of 48 hours’ notice of cancellation is required for any purchase of the Products and will only be accepted subject to written confirmation being received from you and responded to by CHAMP. CHAMP reserves the rights to withhold administrative costs at its complete discretion and by notifying you in writing of its intention to do so. Any Products opened and/or used by you will not be able to be returned and/or refunded.
Unless otherwise stated, the price and any other sums payable for any Product is inclusive of GST.
OUR REFUND POLICY

Our main priority is your happiness, which means we stand by our product 100%, no matter what, whatever it takes!
If you’re not happy with your purchase, get in touch with us within 7 days from delivery and we’ll happily provide a replacement or refund less return postage fees.
The health advice and Products presented by CHAMP and other associated third parties are in no way intended as a substitute for medical consultation. The information and material on the website are not intended to amount to advice on which You can rely. All colours and designs displayed on the Website are indicative only and we cannot undertake to match them. We therefore do not accept any responsibility for any errors, omissions, or any inaccurate Material on the Website. Further, We do not promise that the Website and/or the Material will be uninterrupted or error free or that any defects will be corrected. We will not be liable for any loss or any damage arising out of or in connection with access or use of the Website and/or the Material except that nothing in these Terms excludes or limits any liability for losses which may not be lawfully excluded or limited by applicable law.
You (and your related parties) agree to defend, indemnify and hold harmless CHAMP, our officers, related entities, directors, employees, agents, subcontractors, licensors, and suppliers, from and against all claims, actions, demands, liabilities and settlements, arising in connection with your use of the Website and/or Products or your breach of any of these Terms and Conditions.
These Terms and Conditions constitute the entire agreement between you and CHAMP with respect to this Website and the Products and the Warranty and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written with respect to this Website. A printed version of these Terms and Conditions and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Any rights not expressly granted herein are reserved. The rights provided in these Terms and Conditions are cumulative and not exclusive of any other rights available in any other instrument or at law. These Terms and Conditions are in addition to and are not prejudiced by or merged in any right a party now has or may have. If any of these Terms and Conditions are illegal, void or unenforceable, they will be ineffective to the extent of the illegality, voidability or unenforceability, but without invalidating the remaining Terms and Conditions. No single or partial exercise of any right, power or remedy precludes its further exercise or the exercise of any other rights, powers or remedies. Any waiver is effective only to the extent that it is in writing.
These Terms and Conditions can only be amended or varied by CHAMP at its own discretion and may not be amended or varied in any other manner.
If any part of these Terms and Conditions is prohibited, invalid, unenforceable in any jurisdiction, that provision will, as to that jurisdiction, be ineffective to the extent of the prohibition, invalidity or unenforceability without invalidating the remaining provisions of these Terms and Conditions or effecting the validity or enforceability of that provision in any other jurisdiction.
